These Terms of Use (“Terms”) govern your access to and use of the Site and any content, forms, newsletters, or resources we make available (collectively, the “Services”). By using the Site, you agree to these Terms and to our privacy policy above.
1) Who may use the Site
You must be at least 13 years old (or the age of digital consent in your jurisdiction). If you use the Site on behalf of a company, you represent you’re authorized to bind that company to these Terms.
2) Acceptable use
You agree not to:
break the law, infringe IP, or violate others’ rights;
upload malicious code, attempt to gain unauthorized access, or disrupt the Site;
copy, scrape, or reverse-engineer the Site except as permitted by law;
use the Site to build a competing product or misrepresent your affiliation with us.

4) AI & content disclaimers

8) Confidentiality for paid engagements
Website content is general information. If you engage us commercially, confidentiality, data handling, deliverables, and fees are governed by a separate Master Services Agreement / Statement of Work. If there is a conflict, the written agreement controls.

THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free.
10) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, iVOLVE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, OR GOODWILL; OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. Our total liability for any claim relating to the Site will not exceed US $100.
11) Indemnification
You agree to indemnify and hold iVolve harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or violation of these Terms.
12) Compliance & export
You agree to comply with applicable laws, including export controls and sanctions. You will not use the Services in prohibited jurisdictions or for prohibited end uses.
13) DMCA / IP complaints
If you believe content infringes your rights, contact us at contact@ivolve.ai with: (a) your contact info, (b) a description of the work, (c) the URL of the allegedly infringing material, and (d) a statement under penalty of perjury that you are authorized to act. We may remove content at our discretion.
14) Changes to the Site or Terms
We may modify or discontinue the Site at any time. We may update these Terms by posting a new version with a revised “Effective date.” Your continued use after changes means you accept the updated Terms.
15) Termination
We may suspend or terminate access to the Site at any time, with or without notice, for any reason. Sections that by their nature should survive (e.g., IP, Disclaimers, Liability, Indemnity) will survive termination.
16) Governing law; venue
These Terms are governed by the laws of San Diego, California, excluding its conflicts rules. Courts located in San Diego, CA will have exclusive jurisdiction, and you consent to their personal jurisdiction.
17) Miscellaneous
These Terms (plus the Privacy Policy) are the entire agreement for Site use. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent.
